Raw Material Licencing Rights

22-May-2015

Since 1998 S4C have maintained storage facilities for raw tape materials (i.e. the material produced during the production of the programmes but which were not included in the finished programmes) at our main Office in Cardiff and also in Unit 2, Cibyn, Caernarfon (formerly Clip Cymru) The companies related to the raw material are listed below.

These programmes were produced on the basis of full assignment rights to S4C, therefore S4C own these raw materials.

It is not possible for S4C to continue to store these raw tapes in the future and it intends to dispose of all tapes, except for those that have been identified special archive value, in accordance with the guidelines of the Archiving and Selection Policy (1998).

Prior to disposal, S4C will offer the original producers of the programmes (or the successor to such Production Company where appropriate) the right to claim the raw tapes that apply to them. This proposal is made subject to the following terms:

The producer will need to collect the tapes of the raw material.

The copyright of the material will continue to belong to S4C but the producer will receive a permanent non-exclusive licence to use the raw material in all media worldwide for ever.

The producer will allow other producers to use clips of the raw material in new programmes for S4C free of charge.

The producer will be able to charge third parties fees for use of the raw material on the condition that the producer gives S4C 30% of any net income that's gained on the raw material.

S4C have already identified a number producers of the tapes and will send a letter to those producers over the next few weeks. If you do not receive a letter but believe that the tapes in the collection apply to you, then please inform S4C.

Please inform us via your business manager by 25 June 2015 if you would like to apply for these tapes. S4C will be disposing of any tapes that are not claimed but will continue to store material of special archival value (e.g. Red Spot materials) in their Cardiff office in accordance with the original Archiving and Selection Policy (1998).
