Pact and broadcasters update pan industry data protection guidelines in line with GDPR

Pact and the public service broadcasters: BBC, Channel 4, Channel 5, ITV, MG ALBA, S4C, STV and UTV have updated data security guidelines for the TV production industry to reflect the new European General Data Protection Regulation ('GDPR') implemented under the Data Protection Act 2018 ('DPA').

The pan industry guidelines have been in place since 2010 but have been substantially reviewed and revised to ensure that they provide producers with adequate clarity on the new GDPR requirements. Pact published the guidance in August 2018 and we are now proud to publish Welsh and English versions of the guidance on the S4C Website.

The updated guidelines are designed to help producers understand the changes so that producers can comply with their obligations under the DPA, which states that production companies are responsible for ensuring they manage and protect personal data properly and in accordance with legislation.

There are two sets of guidelines – an in-depth guidance for more senior members of production/ staff and another for crew. These guidelines cover all aspects of data security including collection of and access to personal and special category data, criminal offence data, children's data, data policies, exemptions, subject access requests, and new reporting requirements to the Information Commissioner's Office ('the ICO') in the event of a loss or breach of data.

Pact and the broadcasters will be holding an event for producers on 20th November featuring the ICO's representative talking about the changes to the DPA and the guidelines. More details can be found here

Pact Chief Executive, John McVay said: "These guidelines are a result of a true collaborative effort from Pact and the broadcasters to ensure that UK producers are clear about their new responsibilities under GDPR. The event we are holding in November will provide additional support for producers to understand their obligations."

The ICO was consulted throughout the drafting of the guidance and the feedback received has helped to ensure that producers can be provided with advice that accurately reflects the requirements of the new legislation. Pact, broadcasters and the ICO will continue to work together to discuss any future data protection guidance developed for producers.
